Turkish Constitutional Court decided that the “right to live” was violated in the case of Uğur Kurt, who was shot in the head by the police in the cemevi garden, an Alevite temple yard, and decided to retry the police and pay compensation to the victim’s wife.
Uğur Kurt was shot in the neck as a result of the fire opened by the police Sezgin Korkmaz during the police attack against the students who were demonstrating for Berkin Elvan in Okmeydanı Cemevi. Berkin Elvan was also killed by the police.
According to Evrensel’s report, the Constitutional Court has decided on the application of Narin Kurt, the wife of the victim Uğur Kurt, who was shot in the neck as a result of police fire during the police attack against students demonstrating for Berkin Elvan at Okmeydanı Cemevi, where he was attending the funeral of his relative. Evaluating Kurt’s application on the grounds of violation of his right to life due to the lack of an effective criminal investigation. The Court of Appeals decided that the material and procedural dimensions of the “right to life” had been violated and decided to retry the police officer who shot Uğur Kurt and for the assailant cop to pay 90 thousand TL compensation to the victim’s wife, Narin Kurt.
Victim Kurt, who underwent two surgeries at Okmeydanı Training and Research Hospital, where he was taken, died despite receiving medical attention there.
The accused police officer Sezgin Korkmaz was sentenced to one year and eight months in prison for ‘causing death’ in the case where he was tried without being arrested for three years. This penalty was converted into a fine of 12 thousand 100 liras (around 630 US dollars) and divided into installments.
